Terms of Service

1. Agreement to Terms

By accessing or using Vivtorok ("the Service"), operated by Vivtorok (individual entrepreneur, Ukraine), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

The Service is an AI-powered CRM platform that provides automated sales agents, multi-channel communication, customer management, appointment booking, and related business tools.

2. Account Registration

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You must be at least 16 years of age to use the Service. By creating an account, you represent that you meet this requirement.

3. User Responsibilities

When using the Service, you agree to:

• Provide accurate business information and keep it up to date.
• Comply with all applicable laws and regulations, including data protection laws (GDPR, etc.) regarding your customers' data.
• Not use the Service to send unsolicited messages (spam) or engage in abusive communication practices.
• Not use the Service for any illegal, fraudulent, or harmful purposes.
• Not attempt to reverse-engineer, decompile, or tamper with the Service.
• Ensure that your use of connected channels (Telegram, WhatsApp, Gmail) complies with their respective terms of service.
• Obtain necessary consents from your customers before using AI agents to communicate with them.

4. AI Agents & Automated Communication

The Service provides AI-powered agents that communicate with your customers on your behalf. You acknowledge that:

• AI-generated responses may not always be perfectly accurate. You are responsible for monitoring and configuring your agents.
• You are responsible for the content your AI agents generate and the communications they send.
• We make no guarantees regarding conversion rates, sales outcomes, or the effectiveness of AI agents.

5. Billing & Subscription

The Service operates on a subscription basis. By subscribing, you agree to the following:

• Payments are processed securely by Stripe. You agree to Stripe's terms when making payments.
• Subscriptions are billed monthly or annually, depending on your chosen plan.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change pricing with 30 days' notice. Existing subscriptions will be honored until the end of the current billing period.
• Refunds are handled on a case-by-case basis. Contact us at mike@lukan.email for refund requests.

6. Intellectual Property

The Service, including its design, code, features, AI models integration, and branding, is owned by Vivtorok and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

You retain full ownership of the data you upload to the Service, including business information, contact data, and conversation history. We claim no ownership over your content.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you agree to the data practices described in the Privacy Policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIVTOROK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. AI-generated content may contain inaccuracies.

10. Termination

You may terminate your account at any time by contacting us or using the account deletion feature in settings. We may suspend or terminate your account if you violate these Terms or if we determine that your use of the Service poses a risk to us or other users.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account termination, unless retention is required by law.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ukraine, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Ukraine.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised Terms.
